WELCOME TO THE REFISHED FAIR FASHION ONLINE SHOP!

The following terms and conditions of sale (hereinafter referred to as "T&C") apply to all orders and the purchase of products via the REFISHED online shop at www.refished.com, hereinafter referred to as the "Online Shop".
Please read these carefully before ordering products from this online shop.
Orders can only be placed via the online shop by private individuals and companies purchasing goods that are not intended for resale.

REFISHED products are intended exclusively for sale to end consumers, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, by placing your order, you confirm that you are acting as an end consumer and do not intend to resell REFISHED products for commercial purposes.

To place an order, you must be at least 18 years old and reside in the EU or Switzerland. By placing an order, you agree to be bound by the terms and conditions listed below. We ask you to ensure that you have read and understood the terms and conditions before placing an order. We only recognize provisions that deviate from the T&C if they are confirmed by us in writing.

We reserve the right to change these terms and conditions from time to time without prior notice to you. The version of the terms and conditions that applies to your order is the one on www.refished.com at the time of your order.

BUYER-SELLER CONTRACT

Your orders via the online shop are binding offers to conclude a contract. We are free to accept these offers within 14 days of receipt or to reject them by notifying you. A binding purchase contract is only concluded when we have accepted your order. This acceptance takes place by sending the ordered products.

PRODUCTS

In our online shop, we sell exclusively original REFISHED products.

We offer the following product ranges:
- “CEMENT”, a range of bags and accessories made from upcycled cement bags (= woven PVC), produced by people with disabilities in a small social workshop in Phnom Penh, Cambodia,

- “FISH”, a range of bags and accessories made from upcycled fish feed bags (= woven PVC), produced by people with disabilities in a small social workshop in Phnom Penh, Cambodia.

- “FLAGS”, a range of bags and accessories made from upcycled museum flags, handmade by seamstresses in Vienna, Austria.

- “SHOES”, a range of espadrille shoes made from upcycled cotton, handmade by seamstresses in Phnom Penh, Cambodia in a fair-producing small workshop.

About the material (used fish feed and cement bags)

We would like to point out that the bags were already printed when the packaging bags experienced their "first life". We are neither the owner nor the producer of the first-life products/brands – we collect and recycle the used material and use it to make new bags and accessories. Furthermore, we have neither influence nor responsibility for the durability of the print on the bags or of the bags themselves, as we did not manufacture this base material.

Quality Promise

We care about the quality of the sewing, the accessories, and the workmanship of every REFISHED product. In the event of a lack of quality or defects, please contact us and we will do our best to repair the product.

Availability/Appearance/Changes to Products

Product models that can be purchased via the online shop are shown on this website. As the material is scarce, it may happen that a product color is suddenly sold out, even if it is displayed in the shop as "in stock". If you want to be sure that your desired product is available, please send us an inquiry before placing your order so that we can let you know if it is available.

Please also note that the products in the pictures are only sample photos and your delivered product may differ from the photo in terms of color or print and cut. For certain larger products (e.g., Soulmate, backpack), we guarantee that the iconic letter or symbol (e.g., the fish) is positioned on the front of the product. For smaller products (e.g., wallets, small pouches...), the processed cutout of the base material is very random and often consists of letters and numbers. We process the whole bag and therefore the fish, for example, cannot be on every product. If, for example, the fish is specifically desired, please indicate this in the request field in the shopping bag.

All product types are available while stocks last. The offer of products in our online shop at a certain point in time does not imply or guarantee that these products will be available at all times. We expressly exclude any liability for out-of-stock items or for products that are unavailable or that differ slightly from the products shown. We reserve the right to discontinue any product at any time. We strive to present all attributes of our products, including design, patterns, colors, branding, and material, as accurately as possible. However, the images displayed in your browser may depend on your device and its settings. We also cannot guarantee that all attributes of our products and the original products you purchase will be correctly represented in the photos, as we only sell individual pieces and, as mentioned above, the photos are examples. Since all our products are unique originals, the characteristics of our products, including design, patterns, colors, branding, and material, may differ from the product photos displayed online. We make no representation or warranty to actual or potential buyers or owners of products displayed in our online shop regarding the accuracy, description, or condition of products. We also expressly reserve the right to change the design, appearance, branding, and/or material of the products offered at any time without prior notice.

DELIVERY AND CHARGES

The following processing and delivery charges apply to all orders in our online shop. All values are stated in Euros (€).

On special request: Express shipping within Austria € 15.00 (for orders placed by 11:00 am, delivery 2 days later in the morning).

We mainly ship within the European Union. If you would like delivery outside the EU, please contact us for prices and details. Please note that any applicable customs duties or taxes must be borne by the recipient and are their responsibility. We strive to process all orders as quickly as possible. However, please note that our REFISHED pieces are handmade. We will process your order within 1-4 days after receipt of payment.

The transit time for shipping is 1-2 working days within Austria (GLS), 3-4 working days to Germany (Post), 2-5 working days within the EU region (GLS), 6-10 working days to the USA (Post). Further countries on request. Delivery may take a little longer during peak seasons. We or our shipping partner strive to adhere to the times stated above, but generally cannot guarantee them in a binding manner. Any non-delivery or late delivery of more than 10 working days must be reported to us. Delivery times cannot be guaranteed. Please note that the maximum value per order is € 2,000.

You will receive an email notification as soon as your order has been processed and is ready for shipment. Orders are shipped with a trusted local or international shipping company. International delivery costs do not include any taxes or duties that may be levied by customs in the destination country, and any applicable duties or taxes are the responsibility of the recipient of the shipment. After accepting our "T&C" policy, you agree to this fact and we cannot accept returns due to customs fees incurred. For more information on taxes, duties, and customs regulations, please contact your local customs office directly. If we are unable to deliver your order or if more than one delivery attempt is required, additional shipping costs may apply. If the ordered products cannot be delivered within 30 days of the day after your order, we may withdraw from the contract, even if we have previously confirmed the conclusion. Should we withdraw, you will be informed immediately and we will refund the product costs. All deliveries are made by registered mail or courier and require a signature upon delivery. For security reasons in particular, REFISHED will not process orders for which a general delivery address, a PO box, a university residence address, or a Fedex address has been provided. The products are sent to the delivery address provided when ordering. The risk of loss and damage to the goods passes to you when you or a third party designated by you has obtained physical possession of the goods. However, if you have commissioned a shipping service provider not offered by us, the risk passes to you upon handover to the shipping service provider. Upon receipt, the shipment must be checked by you for correctness and completeness.

PRICE AND PAYMENT

The total price of your order, including shipping costs, is displayed at the end of the ordering process. By confirming the order, you agree to the price. Every order placed via the REFISHED Online Shop must be paid for immediately at the time of the order. We accept payments via - PayPal - Credit cards (with payment partner app “shopify payments”).
Please ensure that the billing address entered with your order matches the address for which the payment card is registered. Otherwise, we cannot process your order. Your order will only be shipped after your payment method has been checked and after we have received authorization to charge your card. If the institution that issued the credit card refuses payment to us, we are not liable for delays or non-delivery. For international payments with credit cards, the institution that issued your credit card may charge a foreign transaction fee. This is neither our fault nor our responsibility. All goods remain our property until your full payment has been received.

RIGHT OF WITHDRAWAL

As a consumer, you have 14 calendar days after receiving your order to decide whether the item you ordered is the right one for you. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period ends after 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise the right of withdrawal, you must inform us in advance by means of a clear statement (e.g., e-mail) about your decision to withdraw from this contract:

If you make use of this possibility, we will confirm receipt of such a withdrawal to you immediately on a durable medium (e.g., by e-mail). To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, you must return the products immediately and in any event no later than 14 days from the day on which you inform us of the withdrawal from this contract. If you withdraw from the contract, we will refund the sale price of all products, provided they were kept in perfect, original, and unused condition with the original label intact and attached before they were returned. REFISHED determines at its own discretion whether the products are in their original condition when returned. If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), immediately and in any event no later than 14 days from the day on which your decision to withdraw from this contract was communicated to us. For this repayment, we use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier date. You must return the goods to

immediately and in any event no later than 14 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you return the goods before the period of 14 days has expired.

Please note that you must bear the direct costs of returning the goods if you decide to withdraw your order. To ensure the safe return of these items, please use insured shipping. Otherwise, you will be held responsible for any loss and we cannot refund you. You must use the same shipping company that delivered the goods to you, i.e., the company we selected. The costs for the return are estimated at a maximum of approx. 15 EUR (within the EU). You are only liable for any loss in value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. If you do not follow our insurance instructions, we cannot be held liable for loss, damage, or additional costs during shipping.

WARRANTY

We strive to deliver products to you that meet your high expectations in terms of quality and appearance. If the goods you receive are defective, please notify us immediately and return the goods to us without delay, as described in the "Right of Withdrawal" section. In this case, you can choose to rescind the contract or – provided the products are still available – request a replacement delivery. Furthermore, no independent warranty is provided. The provisions set out here do not limit any applicable statutory rights. If you have any questions, please contact our REFISHED team directly and provide them with as much information as possible about your order and your concern.

LIABILITY

REFISHED is only liable to you for damages caused intentionally or through gross negligence. This limitation of liability applies to all claims for damages, regardless of the legal grounds, including tort; it does not apply to any liability under the Product Liability Act, for other guaranteed properties, or for injury to life or limb. The exclusion or limitation of liability for damages according to the preceding paragraphs also applies to any claims against employees or vicarious agents of REFISHED.

RIGHTS

All intellectual property rights to all texts, images, and other materials on this website, such as trademarks, design rights, and copyrights, are the property of REFISHED, and any use of this protected content, including copying or storing such content in whole or in part, except for your own personal, non-commercial use, is prohibited and will be legally prosecuted. You are advised that REFISHED will aggressively enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution for serious offenses.

CONCLUSION

Should any of the provisions of these terms be or become invalid or unenforceable, this shall not affect the validity of all other provisions.
